SPICETAG TERMS AND CONDITIONS

References in these terms and conditions to “we”, “us”, “this website” and “Spicetag” are to Spicetag Design Ltd.
The following terms and conditions apply to all transactions on www.spicetag.com (“this website") and your use of this website. You should read these terms and conditions before placing an order. You will be required to check a box during the checkout process if you accept these terms and conditions. If you do not agree to them during the checkout process we will not accept your order. Anyone under the age of 16 should not register with this website or submit any information to us.
When using this website, you accept that communication with us will be mainly electronic. Our contact with you will be by email. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all sales contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights.

Right to Alter Terms and Conditions
We reserve the right to alter these terms and conditions from time to time without notice. It is your responsibility to regularly check these conditions to see if any changes have been made. We reserve the right to modify or withdraw this website any time without liability to you.

Product Availability
All Spicetag products are subject to availability and may be changed at any time. If we are unable to fulfil your order or if there is likely to be a delay in getting it to you we will contact you at the email address you provided to alert you to the situation.
We take all reasonable measures to ensure that product details, descriptions and measurements given on this website are as complete and accurate as possible. Please be aware that there may be slight variations between these measurements and the products themselves. All our products are subject to availability.


Payment Details and Security
All payments to Spicetag are handled securely by PayPal which accepts payment by credit and debit card. Payment will be debited from your card or account before we send you the products you have purchased. We will then send you an electronic transaction receipt to your email address. If you do not receive this within two working days you should contact us at enquiries@spicetag.com.
If your order is not accepted it may be due to one of the following.
• The product you ordered is out of stock. See Product Availability above.
• We have been unable to obtain authorisation for your payment.
• A pricing or product error has occurred during checkout.
• We have detected a failure to meet the eligibility to order criteria set out in these terms and conditions

Payment Methods
We accept the following payment methods by:
- Mastercard
- Visa and Visa Debit/Electron
- Paypal
Complete the details when required during the checkout process. By processing a payment you confirm that the payment card or Paypal account being used is yours.
In some circumstances we can offer payment via a PayPal invoice. Please contact us by sending an email to enquiries@spicetag.com to see availability.
With the assistance of credit reference agencies, we may undertake searches for the purpose of verifying your identity and the personal information you submit as part of your order. These agencies may check your personal information against any particulars on any database (public or otherwise) to which they have access. They may also use your details in the future to assist other companies for verification purposes. By placing an order with us, you agree to this. For more details of the credit reference agencies we receive information from and share information with, you can send an email to enquiries@spicetag.com.

Indemnity

You agree to fully indemnify us from and against all liability, claims, damages, losses, costs and expenses which include legal fees that arise out of any breach of these terms and conditions by you or any other liability arising out of your use of this website or out of the use of this website by any person using your account number and/or password.

Spicetag's Limited Liability
Spicetag's liability for negligence shall be limited to the total value of the transaction except in relation to liability for death or personal injury. Spicetag will not be liable for any indirect, consequential or special losses even if it has previously been advised of the likelihood of such losses.
We declare that any product purchased from us through this website is of satisfactory quality and reasonably fit for all the purposes for which these type of products are commonly supplied.
Spicetag will at no means be liable for any loss of profits, loss of business, loss of anticipated savings, loss of data(hard copy or digital), loss of any opportunity or any other losses economic or indirect that are suffered or incurred by you that arise out of the subject of these terms and conditions. This shall not affect you statutory rights.
No part of these terms and conditions shall give any limitation to our liability for personal injury or death that result from our negligence or that of our employees or agents for any fraud or fraudulent misrepresentation or for any other kind of matter for which it would be illegal for us to exclude or attempt to exclude our liability under section 2(3) of the Consumer Protection act 1987.


Satisfaction Guarantee
It is paramount to us that you are fully satisfied with any of the products you purchase from our website. If you are not totally satisfied with your product, you can return it to us within 14 days of the dispatch date for items delivered in the UK and 28 days of the dispatch date for items delivered overseas. This is in addition to and does not affect your statutory rights. Please refer to the ‘Spicetag Returns Policy’ section below for more information.


Spicetag Returns Policy
All our garments are printed to order. We ask you to check your size carefully using our size chart before purchasing. Don't forget to allow a bit extra room for movement.
If your item is faulty, not fitting to the stated measurements or you believe it is not as described then please get in contact with us within 14 days of the dispatch date for items delivered in the UK and 28 days of the dispatch date for items delivered overseas and we will happily arrange a replacement or a full refund. By our instruction to send an item back to us and we find that the item is at fault, we will refund the postage cost to send the item back to us to the original credit or debit card used to make the initial payment. We will ask you to keep your postage receipt for proof of postage.

Any returns for garments that are too big/small can be refunded minus original delivery costs or exchanged with an additional delivery cost applied (we will not issue any refund for the cost of postage to send the item back to us in these instances). We will not accept any garments that show visible and/or odorous signs of having been worn prior to being returned for instance by make-up, deodorant, perfume or other odours when trying them on and/or visible wear and tear. When returning items, you should ensure the package is securely wrapped as any damages or losses are at the customer's risk. Items should be sent to the address below:

All refunds will be made once the garment is received back to us. Refunds will only be made to the credit or debit card used to purchase the items.

In the unlikely event that your goods are received damaged or faulty, you should contact us within 14 days of the dispatch date for items delivered in the UK and 28 days of the dispatch date for items delivered overseas. We will then arrange for the items to be exchanged or we will offer a refund provided you return the goods to us within 28 days.
All refunds will be issued to you within seven days of us receiving the returned products.

Delivery Failure

Please note that any items not received must be reported to us within 14 days of the dispatch date for items delivered in the UK and 28 days of the dispatch date for items delivered overseas. Any reports received about undelivered items after these periods will not be accepted for a refund or replacement. In some circumstances we may restrict our business delivery from locations we consider insecure.
We can track delivery within the UK and when items arrive in countries abroad whre available. Please contact us through enquiries@spicetag.com for more information.

Delivery
All items purchased on this website will be dispatched within 1-3 business days of the date of purchase and require a signature on delivery. All items are delivered in the UK by Royal Mail Signed For delivery and overseas by Royal Mail International Signed For delivery.
We aim to meet the dispatch window and these delivery times however during busy periods (Christmas period) these delivery times may take slightly longer. Unfortunately we do not deliver during Bank Holidays so please allow an extra delivery day if orders are delivered during these periods.
We regret that we will not deliver to prisons, hospitals or airports and any other addresses we consider to be insecure before or after the point of sale.

Custom fees, import duty and additional fees/taxes may apply for international shipments. Please contact your local customs office for more information. By purchasing items from this website you accept responsibility for any additional charges made once your items arrive in the destination country. As custom fees vary according to certain countries we are unable to supply information of these costs or hold any control over them. As a result there may be a delay in delivery which is unfortunately out of our control.
By purchasing items from this website you also accept responsibility for determining whether your delivery country has import restrictions on various products and materials. Please contact your local customs office for more information. Again, as a result there may be a delay in delivery which is unfortunately out of our control.
Working Day
"Working Day" means any day of the week other than a Saturday, Sunday and public holiday.


Christmas Delivery
UK Christmas Returns: Please note that after the 18/12/19 any items ordered to be shipped inside the UK are not guaranteed by Christmas 25/12/19. We will not accept returns for items because they did not reach you by Christmas if ordered after that date.
International Christmas Returns: Please note that after the 05/12/19 any items ordered to be shipped outside of the UK are not guaranteed by Christmas 25/12/19. We will not accept returns for items because they did not reach you by Christmas if ordered after that date.

Force Majeure Events
We will not be held responsible or liable for any Force Majeure Event such as any extraordinary event, act or circumstance that occurs beyond our reasonable control that can potentially or will delay or restrict our ability to conduct our business performance.
Please note that our business performance under any sales contract including delivery obligations will be suspended for the period that the Force Majeure event occurs and will give us a reasonable time extension during this period. We will aim to find solutions to continue our obligation to the sales contract as best we can during this period.

Force Majeure Events include:
- Weather occurrences such as flood, storm, earthquake, tsunami, fire, explosion, nuclear fallout or epidemic
- Restricted or complete non-use of public transport such as motor and road transport, railways, shipping, air transport and any other type of public and private transport
- Restricted or complete non-use of public or private telecommunications networks such as telephone lines, cell phone reception, internet and Wi-Fi connectivity
- industrial actions such as strikes and lock-outs, civil actions such as riots, terrorist attacks and terrorist attack threats, civil war, wars, declaration, threat or preparation of war
- Legislation, regulations, restrictions, decrees and acts of any governments


Warrantees
Spicetag is unable to offer any warrantees over and above what it is obliged to provide in accordance with the Sales of Goods Act 1979 as amended by the Sales of Goods and Services Act 1994. This does not affect your statutory right as a consumer.
Intellectual Property
The rights in the design and content of this website are owned by Spicetag as is the copyright of our designs that appear on the products on this website. Any designs submitted by other parties will remain their copyright unless they agree to pass on those rights to Spicetag. You may not copy, reproduce, modify, distribute or display any part of this site, including the designs displayed without permission.
You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in all material or content appearing on this Website shall remain at all times vested in Us or our licensors.
Spicetag and the Spicetag logotype are registered trademarks owned by us.


Jurisdiction
The laws of England and Wales govern these terms and conditions and by using the Website you agree to submit to the jurisdiction of the courts of England and Wales.

Your privacy is assured. All personal information including user information that can identify you will be treated as confidential. We operate in strict accordance with the Data Protection Act 1998 and will only use the personal information you supply us with for the purpose of processing your orders. We will provide you with the details we hold on you at any time at your request.
On visiting this website, we may collect information about the origin of your visit through the internet such as the URL you came from, IP address, domain name, browser type and the country and city where your computer is located as well as any search terms used that linked your visit, the pages of this website that you viewed and buttons on this website you clicked for analytical purposes that will help us to improve the overall functionality of this website, the services we offer and the range of products we choose to display even without you registering on this website.
Upon registering with this website, you will be given the option to receive a newsletter by email that may contain offers, information about our products or discount codes that we find may be of interest to our customers.
